Who we are
Data Craftsman (ABN 43 673 283 326) is an Australian AI research and engineering lab based in Newcastle, New South Wales. In these terms, "we", "us" and "our" mean Data Craftsman, and "you" means the person using our website or services.
What these terms cover
These terms cover this website (datacraftsman.com.au) and the information on it. We don't currently offer accounts, subscriptions, paid products or a hosted AI service. If we offer any of those in the future, we'll publish additional terms for them, and those terms will apply to that service.
Our models, code and datasets
We release models, code and datasets through third party platforms such as Hugging Face and GitHub. Each release comes with its own licence, for example CC BY 4.0 or Apache 2.0, stated in its model card or repository.
- Your use of a release is governed by its licence. If a licence conflicts with these terms, the licence applies to that release.
- Model cards describe what each model was trained on, what it is intended for and its known limitations. Please read them before you rely on a model.
- We ask that you use our models lawfully and responsibly, and that you don't use them to harm, deceive, harass or discriminate against people.
Using our website
You may use our website for any lawful purpose. You must not:
- use the website in a way that breaks any law or infringes anyone else's rights;
- interfere with, disrupt or attempt to gain unauthorised access to the website or the systems that host it;
- use automated means to place excessive load on the website, or scrape it in a way that degrades it for other people;
- misrepresent your relationship with us, or imply that we endorse you or your products; or
- use our name, logo or branding without our written permission, except to accurately refer to us or our work.
AI output is not advice
Artificial intelligence and machine learning are rapidly evolving fields of study. Models can produce output that is incorrect, incomplete, biased or offensive, even when it sounds confident. Our models are research releases. Output from them is not professional, legal, medical, financial or other advice, and you should check it before relying on it, especially where it could affect a person.
You are responsible for how you use our models and their output, including making sure your use complies with the laws that apply to you.
Intellectual property
We own, or are licensed to use, the content on this website, including its text, design, logo and graphics. You may view, share and link to it for personal and non-commercial purposes, and quote it with attribution. Other uses need our permission, except where a release licence or the law says otherwise.
Our publications may carry their own licence, stated on the publication. Our name and logo aren't licensed by any model or code licence.
Third party services
Our website links to services we don't control, including Hugging Face, GitHub, LinkedIn and Medium. Their own terms and privacy policies apply when you use them, and we aren't responsible for their content or practices.
Feedback
We welcome feedback on our work. If you send us feedback or suggestions, you agree that we may use them to improve our models and research without any obligation to you.
Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where our liability for failing to comply with a consumer guarantee can be limited, it is limited, at our option, to supplying the relevant services again or paying the cost of having them supplied again.
Disclaimer
Subject to the Australian Consumer Law section above, our website, models, code and publications are provided "as is". To the extent permitted by law, we make no warranties about them, including that they are accurate, complete, fit for a particular purpose or free of errors, and we don't guarantee the website will always be available.
Limitation of liability
To the extent permitted by law, we are not liable for any indirect or consequential loss, or for any loss of profit, revenue, data or goodwill, arising from your use of the website or our releases. Because we provide the website and our releases free of charge, our total liability to you for any claim relating to them is, to the extent permitted by law, limited to AUD $100.
Changes to these terms
We may update these terms from time to time, for example when we launch a new service or the law changes. We'll post the updated terms on this page and change the date at the top. If you keep using the website after an update, the updated terms apply.
Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that can hear appeals from them.
